I stopped reading after I ran across the rather sloppy "That has now changed." comment, which missed the real change in the patent act - when the act changed the amounts one can collect to a "not more than" amount.

Missing such a fundamental concept does not bode well.

Real simple folks
- marking is not a right (having a patent or an application gives you the option to mark, not the right to mark).
- marking carries responsibilities (Yes Virginia, you cannot simply mark and forget - patents by their very nature are for Limted Times Only).
- marking is not an invitation to investigate status - it is the status.
- how to avoid? - police your marks.
