How many bites at the apple do the generics get? Final decision of the CAFC vacated the inequitable conduct filing, and the parties settled the case before the district court could issue a final ruling- so the patents are currently held valid, infringed and enforceable. This should be a slam dunk motion to dismiss, but who knows these days?

Of the inequitable conduct in the previous Endo case, what became of the CAFC interpretation:

The CAFC then vacated the trial court’s judgment that the patents-in-suit are unenforceable due to inequitable conduct and remanded the case for further proceedings consistent with this opinion. The trial court’s judgment of infringement was affirmed.
